Welcome to Zingmo. These Terms and Conditions govern your use of the Zingmo application and website. By accessing or using Zingmo, you agree to be bound by these terms.Zingmo is operated by Busytaal ("Company", "we", "us", or "our").

1. Use of the Service

Zingmo is a stateless and cloud-synced checklist application. You agree to use the service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of Zingmo. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within Zingmo.

2. Accounts and Billing

Certain advanced features (Zingmo Pro) require a paid subscription. You can view our available subscription tiers on our Pricing Page.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By upgrading to Pro, you agree to Paddle's checkout terms and conditions.

3. User Generated Content

You retain all rights in, and are solely responsible for, the checklists and content you create and share using Zingmo. However, by publicly sharing a stateless link to a checklist, you grant others the ability to view, import, and duplicate that checklist's content into their own workspaces.

4. Intellectual Property

All content, design, graphics, compilation, magnetic translation, digital conversion and other matters related to Zingmo are protected under applicable copyrights, trademarks and other proprietary rights. The copying, redistribution, use or publication by you of any such matters or any part of the Zingmo website or app is strictly prohibited.

5. Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

6. Limitation of Liability

Zingmo is provided "as is" without warranties of any kind, whether express or implied. We are not liable for any data loss, including data lost due to URL truncation when using stateless links across third-party platforms, or temporary service interruptions. In no event shall Busytaal, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages.
